Federal Crimes Defense Lawyer

Talk to an Attorney Who Knows Federal Procedures

The laws and court procedures are different in federal and state courts. A motion that works well in a state court, for example, may not work at all in a federal court.

At the Otis & Johnson law firm in Covington, Kentucky, our lawyers have the experience and knowledge to represent people charged with federal crimes. We handle drug distribution defense, fraud defense, computer crimes defense and other federal charges.

Federal Charges Include Mandatory Minimums, Firearms Enhancements

Federal sentencing guidelines are tough, but as experienced criminal defense attorneys, we know the rules, and we know how to work with prosecutors and the courts to mitigate mandatory minimums. Every case is different — and every client deserves careful consideration of the case.

  • If a firearm was used in a federal crime, prosecutors may add on a weapons enhancement. That additional enhancement will add five years to a sentence and, in some cases, more than five years.
  • It is important to have a lawyer who understands the federal sentencing guidelines, makes motions to vary from the guidelines, and knows how to object to enhancements based on the presentence investigation (PSI) report.
  • Previous criminal convictions can have a big impact on sentencing. At our law firm, we work to get previous minor criminal convictions expunged so that a criminal history category is lower than it would have been if all offenses had been included. We know how to present the judge with information that could lead to a downward departure from sentencing guidelines.
  • Drug offenses, including drug distribution or trafficking, carry extensive penalties. Asset forfeiture and firearms enhancements can make a long sentence worse.
  • In a fraud case — bank fraud or prescription drug fraud or HGH fraud, for example — each incident can add additional time to a sentence.
  • Computer-related crimes are often charged in federal courts — ID theft, for example, or computer sex crimes.
  • Any federal case that involves another person may have the additional charge of conspiracy or racketeering. In some cases, conspiracy may be the only charge and can be based on one interaction.
